Prime Minister approved of construction investment project of Hoa Cam IZ phase 2
On March 19, Management Board of Da Nang Hi-Tech Park and Industrial Zones said that the Prime Minister had just issued Decision No. 363/QD-TTg (March 18, 2022) approving the investment policy of the infrastructure construction and business project of Hoa Cam Industrial Zone – phase 2 (Hoa Tho Tay ward, Cam Le district and Hoa Nhon commune, Hoa Vang district, Da Nang city).
Accordingly, Hoa Cam Industrial Zone (IZ) infrastructure construction and business project – phase 2 (hereinafter referred to as the Project) has a scale of 119 hectares, supplemented with 1,019 hectares to reach the scale of 120,019ha and land use norms of Da Nang city’s IZs. The project’s operation duration is 50 years from the date of land lease decision.
The Prime Minister has assigned the Ministry of Planning and Investment to take responsibility for the content of the report on appraisal of the project’s investment decision and perform state management responsibilities in monitoring and directing industrial zones as prescribed by the laws.
Simultaneously, the Prime Minister assigned People’s Committee of Da Nang City to take responsibility and direct the formation of investors selection plan to implement the Project and ensure the compliance with provisions of the law on investment, bidding, land, construction management of industrial zones and economic zones and related laws.
The Prime Minister also assigned the People’s Committee of Da Nang City to direct the Management Board of the Hi-Tech Park and Da Nang Industrial Parks to coordinate with concerned agencies to accurately determine total investment capital of the project, ensuring correspondence between the area for project implementation and regulations of law on construction. Incentives, investment support and conditions have to comply with current regulations.
People’s Committee of Da Nang City is responsible for ensuring the accuracy of the information, reported data, and appraisal contents in accordance with law; implementing the Project in line with the planning approved by competent authority; must not adjust the use purpose of remaining planned area of the industrial zone approved by the Prime Minister without the approval of competent authority.
At the same time, taking full responsibility for the implementation of order and procedures in entitling secondary investors to build projects within the scope of the industrial zone planning, ensuring compliance with the provisions of law; relocating ready-built projects within the IZ according to the approved plan.
The People’s Committee of Da Nang City is also responsible for reviewing the current land use status of the land area expected to implement the Project; ensuring the change of land use purpose in accordance with Resolution 86/NQ-CP dated October 7, 2019 of the Government. In case public property is located within planned project area, it must be handled in accordance with the law on public property without any loss or damages. A plan for land supplementation or increasing the efficiency of other rice-growing lands to compensate for the converted one according to the provisions of Article 134 of the Land Law has to be prepared properly.
In particular, Decision 363/QD-TTg (March 18, 2022) of the Prime Minister emphasized, the project will only be implemented after the conversion of land use purpose, of which land for rice-growing is converted to implement the project properly according to the laws on land, the law on management and use of rice-growing land, and after obtaining approval of the environmental impact assessment report by the competent state agency in accordance with the provisions of the Law on Environmental Impact Assessment.
The Prime Minister also assigned the People’s Committee of Da Nang City to direct the Management Board of the Hi-Tech Park and Da Nang Industrial Parks and relevant agencies to monitor and evaluate the implementation of the Project, in which noticeably the progress of the project would be no later than 36 months from the date on which the land is handed over to the Investors by the State. Management and use of cemetery and religious land within the IZ must ensure the consent of the community to avoid arising complaints and lawsuits during the implementation of construction investment and attracting investment to the IZ.
